The role of the Data Enforcer
in a Data Asset Foundation
A Data Asset Foundation is designed to operate within a trusted governance model. Alongside the DAF Council and assurance providers, the Bill introduces a specialist oversight role: the Data Enforcer.
What is a Data Enforcer?
Under the Bill:

- A Data Enforcer is a person who meets the applicable criteria (which may include qualifications and certifications) and has the functions set out in the Data Governance Framework.
- The Data Enforcer must act in accordance with the Data Governance Framework when exercising those functions.
- Regulations may confer functions on Data Enforcers and establish reporting frameworks for compliance assessment.
Council Cooperation is Mandatory
The Bill requires that the Council of the Data Asset Foundation must cooperate with and provide reasonable assistance to the Data Enforcer to enable the Data Enforcer to carry out its functions.
Information-sharing with the
Data Asset Registrar
The Bill also provides that information received from the DAF by the Data Enforcer in the performance of its functions under the Act may be disclosed to the Data Asset Registrar.

The detailed scope of the Data Enforcer’s oversight (including reporting cadence, operational procedures and any reserved matters) is expected to be shaped through the Data Governance Framework and supporting regulations.
